3. Client Responsibilities

As a client, you agree to:

• Provide Information: Supply all necessary information, content, materials, and access required for project completion
• Timely Feedback: Provide timely feedback and approvals to avoid project delays
• Payment: Make payments according to the agreed payment schedule
• Content Ownership: Ensure you have the legal right to use all content (text, images, logos) provided to me
• Compliance: Ensure your website and content comply with all applicable laws and regulations
• Communication: Maintain clear and professional communication throughout the project

4. Payment Terms

Payment Structure

Payment terms will be specified in individual project proposals. Typical payment structures include:

• Deposit: 30-50% upfront deposit required to begin work
• Milestone Payments: Payments due upon completion of specific project milestones
• Final Payment: Due upon project completion and before final delivery

Payment Methods

Accepted payment methods will be specified in your project proposal and may include bank transfers, PayPal, Stripe, or other agreed methods.

Late Payments

Late payments may result in:

• Project work suspension until payment is received
• Late fees of 1.5% per month on overdue amounts
• Website or service access restrictions

Refunds

Deposits are generally non-refundable once work has commenced. Refund eligibility will be determined on a case-by-case basis and outlined in the project agreement.

5. Project Timeline and Delays

Project timelines are estimates based on the information provided and assume timely client cooperation. Timelines may be affected by:

• Delays in receiving content, feedback, or approvals from the client
• Scope changes or additional feature requests
• Third-party service issues (hosting, domain, APIs)
• Force majeure events

I will make reasonable efforts to meet agreed deadlines but cannot guarantee delivery dates if delays are caused by factors outside my control.

6. Intellectual Property Rights

Client Content

You retain all rights to content (text, images, logos, branding) you provide. By providing content, you grant me a license to use it for the purpose of completing your project.

Final Deliverables

Upon full payment, you will own the final website and custom code developed specifically for your project. This includes:

• Custom designs created for your website
• Custom code written specifically for your project
• Final website files and databases

Third-Party Resources

Websites may include third-party resources (themes, plugins, libraries, fonts, stock images) that are licensed separately. You are responsible for ensuring compliance with their respective licenses.

Portfolio Rights

Unless otherwise agreed in writing, I retain the right to:

• Display completed projects in my portfolio
• Use project screenshots for marketing purposes
• Reference you as a client (with permission)

7. Warranties and Disclaimers

Service Warranty

I warrant that:

• Services will be performed with reasonable skill and care
• Work will be substantially similar to approved designs and specifications
• I have the right to provide the services offered

Disclaimer of Warranties

I do not warrant that:

• The website will be error-free or uninterrupted
• Defects will be corrected immediately
• The website will meet all your requirements
• Third-party services (hosting, plugins) will function perfectly

8. Support and Maintenance

Post-Launch Support

Unless specified in your project agreement, basic post-launch support is provided for:

• Bug Fixes: 30 days of bug fixes for issues directly caused by my work
• Training: Basic training on how to use your website's features

Ongoing Maintenance

Ongoing maintenance, updates, and support beyond the initial support period are available as separate services with their own terms and pricing.

Not Included

The following are not included in standard services:

• Content updates and additions
• Feature additions or modifications
• Third-party plugin or theme updates
• Issues caused by client modifications
• Hosting or server issues

9. Limitation of Liability

My total liability for any claims arising from or related to services provided shall not exceed the total amount paid by you for the specific service giving rise to the claim.

I am not liable for:

• Losses caused by your failure to provide accurate information
• Issues arising from third-party services, hosting, or software
• Unauthorized access or alterations to your website
• Loss of data due to circumstances beyond my control
• Business losses or damages

10. Confidentiality

I respect the confidentiality of your business information and will not disclose confidential information to third parties except:

• With your written consent
• As required by law
• To subcontractors bound by confidentiality obligations
• Information that becomes publicly available through no fault of mine

11. Termination

Termination by Client

You may terminate the project at any time by providing written notice. Upon termination:

• You are responsible for payment for all work completed up to the termination date
• Deposits are non-refundable
• You will receive all work completed to date

Termination by Me

I reserve the right to terminate services if:

• Payment is not received according to agreed terms
• You breach these Terms
• You request work that is illegal or unethical
• The working relationship becomes untenable

12. Website Use and Restrictions

When using my website, you agree not to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorized access to any part of the website
• Interfere with or disrupt the website's functionality
• Copy, reproduce, or redistribute website content without permission
• Use automated systems to access the website
• Transmit viruses, malware, or harmful code

For existing projects, changes to Terms will not affect agreements already in place unless mutually agreed in writing.
